Rudy Giuliani said he is considering legal action against House Democrats, who have subpoenaed him for documents related to the whistleblower complaint against President Trump about a July phone call with the Ukrainian President Volodymyr Zelenskiy.
During an interview on Fox News on Tuesday, Oct. 1, the former mayor of New York City disclosed his idea of fighting the Democrats in their impeachment inquiry.
“I had a couple of talks with civil rights lawyers and a constitutional lawyer today, and here’s what they are recommending. That we should bring a lawsuit on behalf of the president and several of the people in the administration, maybe even myself as a lawyer, against the members of Congress, individually, for violating constitutional rights, violating civil rights,” he told host Laura Ingraham.
Giuliani accused Democratic legislators of doing “extraordinary things,” including interfering with the ability of the president to adhere to Article II, Section 3, of the Constitution in order to ensure “laws be faithfully executed.”
“They are doing extraordinary things. For example, they are violating—they’re interfering with the president in exercising his rights under Article II: The president United States conducts the foreign policy of the United States,” Giuliani said. “They’re calling foreign leaders. They are going to foreign capitals.”
“This is worse than McCarthy!” he later added, presumably referring to Sen. Joseph McCarthy.
House Speaker Nancy Pelosi (D-Calif.) launched an official impeachment inquiry into President Trump on Tuesday, Sept. 24. A whistleblower complaint from an intelligence officer raised concerns that Trump might have leveraged millions of dollars in security aid to persuade Zelenskiy to help Giuliani investigate Biden and his son Hunter, although Trump and his allies insist that there was no “quid pro quo.”
Three House committees on Monday subpoenaed Trump’s personal attorney Rudy Giuliani for key documents related to the Ukraine controversy.
One day later, Giuliani responded by tweeting, “I have received a subpoena signed only by Democrat Chairs who have prejudged this case. It raises significant issues concerning legitimacy and constitutional and legal issues including, inter alia, attorney client and other privileges. It will be given appropriate consideration.”
